What Is Covered

This Limited Warranty covers any defects or malfunctions in your LifeGuard^TM product occurring during normal, personal, non-commercial, non-clinical use.

How Long Coverage Lasts

This Limited Warranty is in effect and provides coverage for a period of two (2) years from the date of original purchase of your LifeGuard^TM product. Notwithstanding anything to the contrary elsewhere, the period of coverage under any warranty on any replacement LifeGuard^TM product provided under this Limited Warranty shall be for the unexpired portion of the warranty period applicable to the original LifeGuard^TM product.

ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY, ARE LIMITED TO THE APPLICABLE WARRANTY PERIOD SET FORTH ABOVE.

What ViVre Medical, Inc. Will Do

ViVre Medical, Inc. is the manufacturer of this LifeGuard^TM product. While this Limited Warranty is in effect, ViVre Medical, Inc. will, at its sole option, repair or replace your LifeGuard^TM product with the same or comparable model free of charge (except you must pay for shipping charges set forth below) in the event of a defect or malfunction in your LifeGuard^TM product occurring during normal, personal, non-commercial, non-clinical use.

What This Limited Warranty Does Not Cover

This LifeGuard^TM product is for personal use only and is not intended for commercial or clinical use. Purchase receipt or other proof of date of original purchase is required and must be provided to ViVre Medical, Inc. before warranty performance.

This Limited Warranty does not cover normal wear of the LifeGuard^TM product.

This Limited Warranty and the remedy provided herein are exclusive and, to the greatest extent permitted by applicable law, in lieu of all other express and implied warranties, and unless stated herein, any statements or representations made by any other person or entity are void.

NEITHER VIVRE MEDICAL, INC., ITS AUTHORIZED DISTRIBUTORS, NOR THEIR RESPECTIVE AFFILIATES SHALL BE LIABLE FOR ANY LOSS, INCONVENIENCE, INJURY OR DAMAGE (INCLUDING DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMGES) RESULTING FROM THE FAILURE, USE, OR IMPROPER USE OF THIS LIFEGUARD^TM PRODUCT OR THE FAILURE TO HEED ANY WARNING, DISCLAIMER OR INSTRUCTION APPLICABLE TO THIS LIFEGUARD^TM PRODUCT, OR THE INABILITY TO USE THIS LIFEGUARD^TM PRODUCT, WHETHER ARISING OUT OF ANY BREACH OF THIS LIMITED WARRANTY OR ANY OTHER LEGAL THEORY.

Neither ViVre Medical, Inc. nor its authorized distributors assume any responsibility or liability for injuries, damages, or penalties incurred or suffered resulting from the use of this LifeGuard^TM product in an improper manner or in a manner or location other than that for which this LifeGuard^TM product is intended or from failure to heed and to comply with any warning, disclaimer or instruction applicable to this LifeGuard^TM product.

This Limited Warranty is void if: the housing on the LifeGuard^TM product has been opened or removed following retail purchase or if the LifeGuard^TM product fails to function properly as a result of misuse, abuse, neglect, mishandling, misapplication, adjustments, alteration, modification, commercial, or clinical use of the LifeGuard^TM product, or other acts or omissions which are beyond the control of ViVre Medical, Inc. or its authorized distributors.

How To Get Service

If your LifeGuard^TM product proves defective during the Limited Warranty coverage period, please return the LifeGuard^TM product in the original box, postage prepaid to:

You must include $10.00 (payable solely by check or money order payable to ViVre Medical, Inc.) for return shipping and insurance. We are unable to deliver to P.O. boxes. Please allow 6-8 weeks for delivery.

You must include with your returned LifeGuard^TM product a letter that states your name, street address, daytime telephone number, a complete and detailed description of the problem with the LifeGuard^TM product, and the circumstances under which the problem arose and a copy of your dated cash register receipt or other proof of the date of purchase.

How State Law Relates To This Warranty

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above exclusions and limitations may not apply to you. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.
