Notice of Privacy Practice

This notice describes how medical information about you may be used and disclosed and how you can get access to this information.

What is this notice? ViVre Medical, Inc. (VMI") is the manufacturer and seller of the Lifeguard™ family of products, including the LifeGuard 30™. VMI is not subject to the federal Health Insurance Portability and Accountability Act, known as HIPAA." However, certain state laws may apply to the receipt and disclosure of health information by VMI or its affiliates, and out of an abundance of caution, VMI has created this notice to inform purchasers and users of products in the Lifeguard™ family of products, including the LifeGuard 30™, how VMI will protect their medical information and disclose it and what rights they have with respect to the information.

User Medical Information: Users of products in the Lifeguard™ family of products, including the LifeGuard 30™, or others acting on the users' behalf, provide VMI with information regarding users' identification, medications, allergies, current medical conditions, past medical conditions, personal demographic information (such as blood type, birth date, height, weight, etc.), emergency contact information, physician contact information, immunizations, insurance data, and other information which the users deem important to convey to persons responding to medical emergencies involving the users (this information collectively is referred to as Medical Information.") VMI and its affiliates provide the User Medical Information to emergency and medical personnel and others who request it through the use of a distinguishing identification code (called a LifePin™) which identifies the user who is the subject of the information. VMI does not intend to disclose User Medical Information publicly except in response to the use of a User's LifePin™unless a situation arises in which VMI or its affiliates are legally permitted or required to disclose the information without consent of the person who is the subject of the information. VMI has the right to revise the manner in which it uses or discloses User Medical Information and, in the event of a significant revision, VMI will change this Notice.

Rights to User Medical Information: A user has the following rights related to User Medical Information:

• Obtain a copy of this notice. Purchasers and users of products in the Lifeguard™ family of products, including the LifeGuard 30™, can read this notice online and download it. Additionally, they may request a copy of the notice by contacting VMI at:

• Authorization to disclose User Medical Information. Before VMI or its affiliates will disclose User Medical Information, other than as described in this Notice, VMI will obtain the User's authorization, which is revocable at any time to stop future use or disclosure.
• Change User Medical Information. If a user of a product in the Lifeguard™ family of products, including the LifeGuard 30™, determines that VMI's User Medical Information is inaccurate or incomplete, the User may request that VMI correct, delete, or add information.
• Accounting of Disclosures. A user of a product in the Lifeguard™ family of products, including the LifeGuard 30™, may request data regarding disclosures of the user's corresponding User Medical Information by VMI or its affiliates.

Situations in which VMI or its affiliates can legally disclose User Medical Information without a user's specific consent:

These are examples of instances, most of which are not anticipated to occur, in which VMI or its affiliates might disclose User Medical Information without specific consent:

• In connection with collection of payment by VMI
• To comply with workers' compensation laws
• For law enforcement purposes as required by law
• In response to subpoena or other court or administrative order
• To provide information requested and required by military command authorities where the user is a member of the armed forces
• In response to requests from government agencies performing specialized government functions, such as protection of high-ranking officials, or for lawful national intelligence activities

Acknowledgement and Authorization

Before completing your purchase of a product in the LifeGuard™family of products, including the LifeGuard30™, or uploading your personal medical information to be stored on such a product, you must acknowledge and agree to the following:
